HC reserves plea order for AAP MLA Amanatullah Khan against Bad Character Tag

The Delhi High Court reserved its order on Friday on a plea by MLA Amanatullah Khan against the city police, who called him “bad character”. The Delhi Police, on the other hand, claimed that due process had been followed by the relevant authorities to arrive at the contested decision and that insufficient material had been submitted to the court to prove any breach of trust on their part. Attorney M. Sufian Siddiqui, acting for the petitioner, claimed that the authorities acted in an absolutely malicious manner, while claiming that a copy of the history sheet, which is a confidential document, was posted on social media by a rival political spokesman Party who slandered him Khan. Khan’s lawyer claimed that the entire history sheet was without material, adding that such a decision must be a precautionary injunction for a person habitually addicted to crime. There are 18 cases in total (against the petitioner). In 14 of these 18 cases, the petitioner was acquitted or dismissed, or the case was aggravated. These 14 cases cannot form the basis. He submitted the remaining 4 cases, which are pending. The Additional Attorney General argued on behalf of the Delhi Police that the applicable regulations were properly followed by the competent authorities in the case and that the decision was made taking into account the material on file and after peer review. The court said it would review the official file related to the contested decision before delivering the order.

Earlier, the Delhi Police stated that the reasons recorded by the permitting authority were confidential and could not be shared with the petitioner. Delhi police had declared Khan of bad character earlier this year, according to an official document.

The proposal for this was sent out by Jamia Nagar Police Station in the Southeast District on March 28 and approved on March 30. A total of 18 FIRs were registered against him, the document said.

According to police, a person who is involved in multiple criminal cases, including serious crimes such as murder and attempted murder, and who could disturb the peace in an area, is considered a bad character.
